§1 General Provisions
1. These regulations govern the use of the Christina Cosmetics Online Store operated at www.christinacosmetics.pl
2. The online store operating at www.christinacosmetics.pl, hereinafter referred to as: Christina Cosmetics Online Store, is operated by TOP COSMETICS EUROPE Spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, at ul. Zajęcza 15, 00-351 Warsaw, RP, KRS 0000987011, NIP 5213980858, REGON 522856062 (hereinafter referred to as the Company).

4. The regulations of the online store are permanently placed on the website www.christinacosmetics.pl in a way that allows Customers to easily obtain, reproduce and save their content, e.g. by saving to disk or printing. The regulations are also made available to Customers before concluding an agreement.
§ 2 Definitions
The terms used in these regulations mean:1
1. Consumer - a natural person within the meaning of Article 22<sup>1</sup> of the Civil Code,
2. An entrepreneur with consumer rights - a natural person concluding a contract directly2 related to their business activity, when it results from the content of this contract that it does not have a professional character for this person, resulting in particular from the subject of the business activity performed by them,3 made available on the basis of the provisions on the Central Register and Information on Business Activity,4
3. Entrepreneur - means a natural person, a legal person or an organizational unit that is not a legal person5, to whom the law grants legal capacity, conducting business or professional activity on its own behalf and performing a legal act directly related to its business or professional activity,6
4. Service Provider/Seller7 - TOP COSMETICS EUROPE Limited Liability Company with its registered office in Warsaw, at ul. Zajęcza 15, 00-351 Warsaw, RP, KRS 0000987011, NIP 5213980858, REGON 522856062,
5. Online Store - online store operated at www.christinacosmetics.pl by the Company,
6. Civil Code - Act of 23 April 1964 (Journal of Laws of 2023, item 1610, as amended),
7. Goods and Services - all services provided and goods that are the subject of the sales contract between the seller and the buyer,8
8. Regulations - these regulations for the provision of services by electronic means within the meaning of Art. 8 of the Act on the provision of9 services by electronic means of 18 July 2002 (Journal of Laws 10 of 2020, item 344, as amended),
9. Customer/Buyer - a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who11 places or plans to place an Order within the Online Store using electronic means, including a Consumer, an Entrepreneur with consumer rights and an Entrepreneur,12
10. Order - a declaration of will by the Customer, in which the Customer accepts the Seller's sales offer, which includes13 in particular the price, type, quantity of Goods or Services within the scope of sale via the online store.
11. Consumer Rights Act - Act of 30 May 2014 on Consumer Rights (Journal of Laws 14 of 2020, item 287, as amended).
§ 3 Rules for using the online store
1. Prices of all goods and services offered by the Store are gross prices15 (include VAT) and are expressed in Polish zloty. Deviations from the Polish currency principle are clearly marked.
2. Prices displayed on the website16 of the Christina Cosmetics store, as well as descriptions of goods and services, constitute only commercial information and not an offer within the meaning of the Civil Code. They become binding - for the purposes17 of concluding a specific contract - only upon confirmation of acceptance of the order for execution by the Seller.
3. The Seller uses discount codes in the Online Store18 Christina Cosmetics entitling to purchase goods with a discount listed on the coupon. Discount codes cannot be exchanged for a cash equivalent.19
4. To place an order in the online store, acceptance of these Regulations is necessary.
5. To successfully place an order in the Online Store, it is necessary to have a device with Internet access that allows you to browse websites, as well as a keyboard or other device that allows you to correctly fill out electronic forms. It is recommended to use the latest versions of Internet browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for system20 OS X, etc.
6. The Online Store website uses Responsive Web Design (RWD) technology, which adapts the content of the website to the device on which it is displayed. The Store website is prepared to be displayed on both desktop computers and mobile devices.
7. The website of the Online Store21 Christina Cosmetics has an SSL certificate - a secure communication encryption protocol.
§ 4 Conditions of concluding a sales contract
1. Orders in the Christina Cosmetics online store can be placed by completing the appropriate forms available on the store's website.
2. When placing an order, the customer is obliged to provide correct personal data: name and surname, address, e-mail address and mobile phone number.
3. After receiving the order, the Seller confirms its receipt and at the same time informs about the acceptance of the Order22 for execution. The order is confirmed by the Seller sending an appropriate e-mail message to the Customer to the address provided in the order form. At the moment of confirmation of the acceptance of the order for execution by the Seller,23 the contract is considered to be concluded.
4. The content of the sales agreement is made available and recorded by making these Regulations available on the website of the Online Store, sending24 appropriate information to the e-mail address of the Customer provided when placing the order, referred to in §4 point 25 2.
5. Orders can be placed in the Online Store 24 hours a day, every day of the year.
§ 5. Payment method and payment deadline
1. In the Christina Cosmetics online store you can pay in one of the following ways:
about payment on delivery,
about via external payment services27 (PayU).
2. After placing the order, the Customer receives a bank account number via e-mail to which the appropriate amount should be transferred. Once the payment is credited to the bank account28 of the Christina Cosmetics store, the order is forwarded for execution.
3. The online store allows payment via the PayU electronic payment system.
4. The customer is obliged to make the payment using one of the above-mentioned methods within 1 business day of concluding the sales contract.
5. In case of choosing cash on delivery, the Customer is obliged to make the payment upon receipt of the shipment.
§ 6 Delivery
1. The ordered goods are delivered exclusively within the territory of the Republic of Poland and are delivered to the address indicated by the Customer in the order form.30
2. The time of preparation for shipment of goods is indicated on the Christina Cosmetics Online Store pages and is up to 72 hours. This is an approximate time. The Seller will make every effort to deliver the goods within the time specified in the product card in the online store. The actual delivery time depends on the carrier. In the event that the goods cannot be delivered within the above-mentioned time, the Buyer will be informed immediately.
3. Delivery of the ordered Goods is carried out via:31

4. At the time of handing over the goods to the courier company, the Buyer is notified of this fact by sending an e-mail to the address provided in the order.32
5. The costs of delivering the Goods, which in addition to the price of the Goods are borne by the Customer, are provided on the Store's website when placing the Order.33
6. The cost of delivery of the goods in the case of choosing cash on delivery is covered entirely by the Customer.34
§ 7 Withdrawal from the contract
1. A Buyer who is a Consumer or an Entrepreneur with consumer rights and who has concluded a distance or off-premises contract has the right to withdraw from the concluded sales contract35 within 14 days from the date of delivery of the goods to him without giving any reason.
2. In the event of exercising the right referred to in the36 preceding point, the Buyer should inform the Seller thereof by submitting a declaration of withdrawal on the form provided37 to the Buyer by the Seller, which may be sent by post to38 the following address: Level Up Fulfillment Group ul. Wólczyńska 133 Building 6, warehouse 11/4 01-919 Warsaw (address for correspondence, returns and complaints); it may also be done electronically using the electronic withdrawal form sent to the Seller's e-mail address39 [e-mail address removed] In order to meet the deadline, it is sufficient to send the declaration before it expires.
3. The form for declaration of withdrawal from the contract (Annex No. 1 to these Regulations)40 is provided to the Buyer in paper form (in the documentation attached to the shipment)41 or in electronic form.
4. The Consumer is obliged to return the Product in respect of which he withdrew from the sales agreement immediately, no later than within 14 days from the date of submitting the declaration of withdrawal from the sales agreement.42 The returned product should be sent to the following address: Level Up Fulfillment Group ul. 5. The cost of shipping the returned Product to the Seller is borne by the consumer. In addition, the consumer bears the direct costs of returning the product, e.g. packaging the shipment.
6. The Buyer is obliged to properly secure the returned goods so as to prevent damage during transport.
7. In the event that the Consumer or Entrepreneur with consumer rights submits a declaration of withdrawal from the contract and after the delivery of the goods subject to return, the Seller shall immediately send confirmation of receipt of the goods subject to return and the declaration of withdrawal from the contract.
8. If the delivered goods are incomplete, show signs of use or damage to the original product packaging, the Seller reserves the right to refuse to accept the shipment or to reduce the refund amount by the value of the damaged goods.
9. In the event of withdrawal from the contract,43 the Seller shall return to the Customer – consumer immediately, no later than within 14 days from the date of receipt44 of the goods subject to return, all payments made by him/her in connection with the contract, including the costs of delivering the Products (except for additional costs resulting from the consumer's choice of45 a method of delivery other than the cheapest standard method of delivery offered by the Seller).46
10. The Seller declares that the refund will be made using the same payment method used by the Buyer. The Seller, in agreement47 with the Buyer, may establish another method of refund that will not involve the Buyer incurring additional costs.
11. The Seller declares that the right of withdrawal does not apply to49 contracts specified in art. 38 of the Act of 30 May 2014 - on consumer rights,50 in particular to contracts:
about where the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his/her individual51 needs;
about where the subject of the service is an item that spoils quickly or has a short shelf life;
about where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package52 for health protection or hygiene reasons if the package was opened after delivery;53
12. By concluding the contract, the Consumer or Entrepreneur with consumer rights confirms that he/she has read the content of these regulations, including confirming that he/she has been notified of54 the right to withdraw from the concluded sales contract within 14 days from the date of delivery of the goods.55
§8 Complaints
1. The basis and scope of the Seller's liability towards the Customer for the non-conformity of the Product with the Agreement (warranty) are specified by generally applicable legal regulations and the following provisions of the Regulations. The Seller is obliged to deliver the product without56 defects. (If applicable) The Seller also provides a guarantee on the terms specified in a separate guarantee document.
2. In the event of finding any mechanical damage that occurred during delivery or in the event of submitting a complaint to the Seller, the Buyer should send information about this fact by letter57 to the address Level Up Fulfillment Group ul. Wólczyńska 133 Building 6, warehouse 11/4 01-919 Warsaw (address for correspondence, returns and complaints) or by e-mail to the address [e-mail address removed] In the notification, it is recommended to indicate the defect that the Customer believes the goods have and, if possible, document the said defect, the date of occurrence of the defect, the request for a method of bringing the goods into conformity with the contract in accordance with art. 560 et seq. of the Civil Code and provide contact details. The above requirements are recommendations58

§9 Rules for publishing opinions
1. Each buyer/customer may publish opinions about goods/services in the appropriate place on the Store's website. The opinion should be written in Polish, in accordance with the rules of correct Polish.
2. Opinions are subjective statements of Customers. The Seller is not responsible for their content.
3. The Buyer/customer declares that his/her statement does not violate applicable legal regulations or the rights of third parties. He/she bears full responsibility for the statements he/she places in the Online Store [store name].
4. The submitted opinion is subject to verification by the seller in terms of checking whether the opinion does not contain content of a prohibited nature, i.e. in particular when the opinion violates applicable regulations, contains prohibited content, advertising, personal data, violates copyrights, etc.

§ 10 Personal data
1. The Seller is the administrator of personal data.
2. The principles of personal data protection can be found in the Privacy Policy of the Christina Cosmetics online store available at www.christinacosmetics.pl.

§ 11 Final provisions
1. The Seller reserves the right to introduce changes to these Regulations for important reasons. Any changes to the Regulations shall enter into force on the appropriate date indicated by the Seller, but not shorter than 7 days.
2. The amended Regulations are binding on the Buyer/Customer if the requirements specified in Articles 384 and 384[1] of the Civil Code have been met, i.e. he/she has been properly notified of the changes and has not terminated the contract within 14 calendar days from the date of notification.

3. Pursuant to art. 8 sec. 3 item 2 letter b of the Act of 18 July 2002 on the provision of services by electronic means, the entity using the website of the online store www.christinacosmetics.pl is obliged not to place illegal content on this website.
4. In matters not regulated by these regulations, the relevant provisions of the Civil Code and the Act of 30 May 2014 on consumer rights shall apply.
5. These Regulations are available at the Internet address www.christinacosmetics.pl
6. Agreements with the seller are concluded in Polish.
7. The Regulations enter into force on 01.06.2024.
